Welcome to Lunaira. By accessing our website and placing an order, you agree to the following Terms and Conditions. Please read them carefully.

1. Definitions

  • Cooling-off period: Time during which the consumer can exercise the right of withdrawal.

  • Consumer: A natural person acting outside their profession or business who enters into a distance contract.

  • Day: Calendar day.

  • Long-term transaction: A contract for a series of products/services supplied over time.

  • Durable data carrier: Any medium allowing storage of information for future reference in unaltered form.

  • Right of withdrawal: Consumer’s option to cancel a purchase within the cooling-off period.

  • Entrepreneur: Lunaira, offering products/services at a distance.

  • Distance contract: A contract made via a system organized by the entrepreneur for remote selling, using one or more means of distance communication.

  • Means of distance communication: Methods for concluding a contract without being physically present together.

  • Terms and Conditions: These general terms.

3. Applicability

These terms apply to every offer, order, and distance contract between Lunaira and the consumer.

  • Consumers are provided the terms before concluding a contract.

  • If electronic, they can be stored on a durable medium.

  • Invalid or unclear provisions do not affect the rest of the terms.

4. Offers

  • Offers may be time-limited or conditional; details will be clearly stated.

  • Product descriptions are accurate, but color may vary.

  • Key offer information includes: price (excluding VAT/import duties), shipping, withdrawal rights, payment/delivery methods, order review instructions, language, and codes of conduct.

5. Formation of Agreement

  • The agreement forms when the consumer accepts the offer and meets conditions.

  • Confirmation is sent electronically.

  • Security measures are in place for online transactions.

  • Product availability applies to every agreement.

6. Right of Withdrawal

  • Consumers may cancel purchases within 14 days of receipt.

  • Products must be handled and returned in original condition and packaging.

  • To withdraw, notify Lunaira via email or written notice within 14 days, then return products within 14 days with proof of shipment.

7. Costs of Withdrawal

  • Return shipping is the consumer’s responsibility.

  • Refunds are processed within 14 days after receipt of the returned item or proof of return.

8. Exclusions from Withdrawal

The right of withdrawal does not apply to:

  • Custom-made or personalized products

  • Products that spoil quickly or are perishable

  • Sealed hygiene products (e.g., underwear, lingerie, cosmetics)

  • Newspapers/magazines, sealed audio/video/software once opened

  • Services linked to specific dates, betting, or events agreed to by the consumer

9. Pricing

  • Prices are fixed during the offer unless VAT or market conditions change.

  • International orders may incur customs/VAT collected by the courier.

  • Typographical errors are non-binding.

10. Conformity and Warranty

  • Products meet the agreement, offer specifications, and legal requirements.

  • Defects or incorrect deliveries must be reported within 14 days.

  • Warranty applies as per manufacturer; exclusions include misuse, unauthorized modifications, or government-mandated materials.

11. Delivery

  • Orders are processed promptly, within 30 days unless otherwise agreed.

  • Delays or unavailable items are communicated within 30 days.

  • Consumers can cancel delayed orders at no cost.

  • Replacement products are offered if available.

  • Risk remains with Lunaira until delivery to the consumer or designated third party.

  • Orders placed on Fridays or weekends may take longer to process.

12. Long-Term Transactions

  • Termination: Consumers may cancel indefinite agreements anytime with 1 month notice. Fixed-term agreements may be canceled at term end.

  • Renewal: Fixed-term agreements do not auto-renew unless specified. Indefinite agreements renew only with cancellation option. Trial subscriptions end automatically.

  • Duration: Agreements longer than 1 year may be canceled after the first year with 1 month notice.

13. Payment

  • Payments are due within 7 working days of the start of the withdrawal period.

  • For services, payment is due after confirmation.

  • Late/non-payment may incur reasonable fees within legal limits.

14. Complaints

  • Submit complaints within 7 days of discovering a defect.

  • Lunaira will respond within 14 days or provide a timeline if longer.

  • If justified, products will be replaced or repaired at no cost.

15. Disputes

  • Dutch law governs all agreements and disputes, even if the consumer resides abroad.
